Criminal trial attorney Sean O'Halloran is experienced in all areas of criminal law.

Upon passing the Bar in 2000, I worked at the State Attorney’s Office prosecuting misdemeanor and felony cases for three (3) years. I handled misdemeanor cases in Charlotte County, including misdemeanor DUI’s, domestic violence batteries, petit thefts, driver’s license offenses and fish and game violations. I tried dozens of cases in Charlotte County and eventually took over the juvenile Prosecutor’s position before moving to take on felony matters in Fort Myers. As a felony Prosecutor in Fort Myers, I tried dozens of cases including multiple murder trials, firearm related offenses, drug violations, robberies, and aggravated battery allegations.

I have been practicing criminal law for over 20 years. My criminal defense practice has been established since 2004. Since then, I have dedicated myself and my practice to defending clients facing criminal charges in Lee and Charlotte County, Florida as well as in Federal Court. Recently, I have evolved my practice to include a partnership with Attorney Robert Foley, to form the Criminal Defense Law Practice of O’Halloran & Foley of Charlotte County, in order to provide a full service criminal defense practice operating out of Punta Gorda, Florida to those facing charges in Charlotte County, Florida

Before you were arrested, it is unlikely that you were afforded an opportunity to (1) conduct your own investigation in support of your own defense, or (2) collect your own witness statements to present your side of the story.

Fortunately, its not too late. Prior to your arraignment, the State Attorney’s Office will review your case. At this time a Prosecutor will review the facts, learn under what circumstances you were arrested, and decide what charges, if any, to file. 

As a former Charlotte County Prosecutor, I have first-hand experience regarding the importance of this procedure. In many cases, an experienced defense attorney, can contact the Prosecutor prior to charges being filed. At this time, through an attorney, you would have an opportunity to present your side of the case in an effort to persuade the Prosecutor not to file charges.

Additionally, there may be legal issues that would prevent the State from filing charges. 

At our initial consultation, we will have an opportunity to fully discuss your case; including defenses to your case, and potential witnesses on your behalf. If retained, I can assist you on preparing your defense and can contact the Prosecutor prior to charges being filed.

In the event that charges are filed, you will need an experienced criminal defense attorney to work in your defense.
